• In New Jersey, endangering the welfare of a child is a serious felony and sometimes a second degree felony, which if plead or found guilty can lead to the individual serving time in state prison.
  • Anyone charged with this can also find themselves in litigation because DIFUS, now known as DCP&P, got involved with their case as well because they found out there was children that were abused or neglected.
  • There are a lot of proofs that the state must have for you to be found guilty.
  • Whether or not DIFUS or DCP&P is involved, contact an experienced criminal defense attorney immediately- this charge is criminal in nature, but also risks the potential of consequences with your own children.

Here in New Jersey endangering the welfare of a child is a serious crime. It’s a felony. In certain circumstances it can be a second degree felony. The reason I mention the degree of crime is because a second degree felony if plead to or found guilty after trial requires an individual, whether previously having a criminal record or not, to serve time in state prison. Obviously, this is not an ideal consequence of a charge.

Also, anyone charged with endangering the welfare of a child may find themselves in litigation in family court as well because DIFUS, now known as DCP&P, got involved in their family and found that they either abused or neglected their child. Again, this is not an ideal consequence from a criminal charge. Just because you’ve been charged with endangering the welfare of a child whether it is yours or another and DCP&P has become involved does not mean all hope is lost. Endangering the welfare of a child is a significant crime as I mentioned before, but there are a lot of proofs that the state must have for you to be found guilty or feel comfortable pleading guilty to that charge. If you’ve been charged with endangering the welfare of a child in any degree is a felony.

Whether or not DIFUS or DCP&P has become involved, you must immediately consult with an experienced attorney in this area of law. The consequences of endangering the welfare of a child are not only criminal in nature, but you risk the potential of causing consequences with your own children. Again, I must advise that if you’ve been charged with endangering the welfare of a child in New Jersey, immediately consult with an experienced criminal defense attorney to discuss the facts of your particular case.
